Terms of Service

These Terms of Service ("Terms") govern your access to and use of MorningBrief, an AI-powered email digest service ("Service") operated by Edoardo Geiss ("we", "us", "our").

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 16 years old to use MorningBrief. By using the Service, you confirm that you meet this requirement.

MorningBrief connects to your Gmail account via Google OAuth 2.0 and uses Claude (Anthropic's AI) to generate structured daily email digests. The Service provides:

• Automated daily email digests delivered to your inbox
• On-demand digest generation via the dashboard
• Priority triage and action item identification
• Draft reply suggestions
• Digest history accessible in the dashboard

Features vary by subscription plan as described in Section 4.

You must sign in using a valid Google account. You are responsible for:

• Maintaining the security of your Google account
• All activity that occurs under your MorningBrief account
• Ensuring the information associated with your account is accurate

You may not use another person's account without their explicit permission. You may not create accounts using automated means or misrepresent your identity.

4.1 Plans

MorningBrief offers two paid subscription plans:

4.2 Free trial

New subscribers receive a 7-day free trial. If you cancel before the trial ends, you will not be charged. After the trial, your subscription begins at the applicable monthly rate.

4.3 Billing

Subscriptions are billed monthly in advance. Payments are processed by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring monthly basis. All prices are in EUR and include applicable taxes.

4.4 Cancellation

You may cancel your subscription at any time via Stripe's customer portal. Cancellation takes effect at the end of your current billing period. We do not offer prorated refunds for partial months, except where required by law.

4.5 Refunds

Refund requests within 14 days of your initial charge (excluding free trial conversions) will be honoured. To request a refund, contact us at edoardo.create@gmail.com. EU consumers retain any applicable statutory rights.

4.6 Price changes

We may change subscription prices with 30 days' notice. Price changes take effect on your next renewal date after the notice period. If you do not agree to the new price, you may cancel before it takes effect.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Use automated tools, scripts, or bots to interact with the Service beyond normal use
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Share your account credentials with others or allow others to use your account
• Use the Service in a way that could damage, overload, or impair our systems
• Misrepresent your identity or affiliation when using the Service

Violation of this section may result in immediate account termination without refund.

When you connect your Gmail account, you grant MorningBrief read-only access to your Gmail. You understand and agree that:

• MorningBrief will access your Gmail solely to generate your email digest
• Email content is processed by Anthropic's Claude API and not retained by MorningBrief
• You can revoke Gmail access at any time via Google Account settings, which will prevent future digest generation
• You are responsible for ensuring that using MorningBrief with your Gmail account does not violate any obligations you have to third parties

Digests are generated by Claude, Anthropic's AI. You acknowledge that:

• AI-generated summaries may contain errors, omissions, or inaccuracies
• Digests are summaries, not substitutes for reading your emails directly
• Draft reply suggestions are AI-generated and should be reviewed before sending
• MorningBrief is not responsible for any decisions you make based on digest content

Always verify important information directly in your inbox before acting on it.

MorningBrief and its original content, features, and functionality are owned by Edoardo Geiss and are protected by copyright and other intellectual property laws.

Generated digests are derived from your own email content. You retain ownership of your underlying data. You grant us a limited licence to process your email data for the sole purpose of generating and delivering your digest.

You may not copy, reproduce, or distribute any part of the Service without our written permission.

We aim to provide reliable, uninterrupted service but do not guarantee 100% uptime. The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with reasonable notice where possible.

If we discontinue the Service permanently, we will provide at least 30 days' notice and refund any prepaid subscription fees for the unused period.

To the fullest extent permitted by applicable law:

• MorningBrief is provided "as is" without warranties of any kind, express or implied
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability to you for any claim arising from the use of the Service shall not exceed the amount you paid us in the 3 months prior to the claim
• We are not responsible for errors, missed emails, or incorrect summaries in AI-generated digests

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law. EU consumer rights are not affected by these limitations.

You agree to indemnify and hold harmless MorningBrief and Edoardo Geiss from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

By you: You may terminate your account at any time by cancelling your subscription and contacting us to delete your account. On termination, your data is deleted within 24 hours.

By us: We may suspend or terminate your account if you violate these Terms, engage in fraud, or for other legitimate reasons. We will provide notice where legally required. Upon termination for cause, no refund will be issued.

These Terms are governed by the laws of Italy. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Italy, without prejudice to any mandatory consumer protection rights applicable in your country of residence.

If you are an EU consumer, you may also use the EU Online Dispute Resolution platform.

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify you by email at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
